Recently we had the chance to argue whether a defined contribution plan was considered the same as a defined benefit plan, and we were able to distinguish the two. This is important in considering how to divide up retirement savings and who is entitled to what assets. The tension in the law concerning equitable distributions and the requirements concerning pensions and defined contributions presents an interesting conundrum.
